Pursuant to NJSA 47:1A-5(i), you shall receive a response in no more than seven (7) business days, with day one starting the day after the request has been received. (Holidays and Townhall closings do not count as business days).

Dear Concerned Livingston Residents, 
This comes in response to your request for public records made under OPRA
and the common law right of access received after regular business hours
on 6/7/23 and considered to be received the next business day, 6/8/23 for:

You did not provide a specific date range of the dates during which the
e-mails were transmitted.  Please provide a date range for us within 7
business days ( by June 21, 2023, as the Township offices will be closed
for the Juneteenth Holiday on June 16, 2023) or your request will be
deemed incomplete and denied pursuant to MAG Entertainment, LLC
v. Division of Alcoholic Beverage Control, 375 N.J.Super. 534, 546 (App.
Div. 2005)  and Elcavage v. Township of West Milford (Passaic), GRC
Complaint Nos. 2009-07 and 2009-08 (March 2010). 
The court cited MAG by stating that “…when a request is ‘complex’ because
it fails to specifically identify the documents sought, then that request
is not ‘encompassed’ by OPRA…” In Elcavage v. Township of West Milford
(Passaic), GRC Complaint Nos. 2009-07 and 2009-08 (March 2010), the
Government Records Council examined what constitutes a valid OPRA request
for e-mails. The Council determined that: “In accord with MAG, supra, in
order to specifically identify an e-mail, OPRA requests must contain (1)
the content and/or subject of the e-mail, (2) the specific date or range
of dates during which the e-mail or e-mails were transmitted, and (3) a
valid e-mail request must identify the sender and/or recipient thereof.”
