Good afternoon,

This is in response to the OPRA records request you submitted on 6/23/22 wherein you seek the following from the Division of Workers’ Compensation:

“All the below requested records and information are in reference to a Workers Compensation claim filed by a Antonio Manata of 1 Crescent Parkway Clark NJ 07066 for an work related injury sustained between January 2018 and June 2018:

- Workers Compensation claim docket number;
- Date of Injury;
- Attorney representing Antonio Manata
- Nature of claim;
- Name of employer;
- Current status of claim;
- All documents submitted by the employer;
- Dates of all past and upcoming hearings”

Filing a request under the Open Public Records Act does not provide a requestor authorization to access information regarding any workers’ compensation claim filed with this Division. The New Jersey Division of Workers’ Compensation is governed by N.J.S.A 34:15-128, which states in pertinent part that no information shall be disclosed from records maintained by the Division of Workers’ Compensation to any person not in the Division of Workers’ Compensation, unless it is information about the claimant requested by the claimant or case party and the information is provided in a manner which makes it “impossible to identify any claimant”, to be used for a reason "directly related to the case".

In light of this request, the claimant has already been identified, therefore providing records would be a violation of N.J.S.A. 34:15-128(a)(1).

This request, as it stands, is denied.
