Records of communications to Bergen County Courthouse
Dear Bergen County Sheriff's Department,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
I request copies of records maintained by the Bergen County Sheriff’s Office (including Court Security) in electronic form for the date range October 8, 2025 through October 20, 2025, that reference Joshua Ben-Asher (including any variants/misspellings) and relate to any assertion/report/rumor that I posed a safety threat (or required special “handling”) in connection with the Bergen County Superior Court / courthouse OR TO ANY BERGEN COUNTY SUPERIOR COURT JUDGE, including but not limited to, Judge DiBiasi.
Please produce the following categories of records:
1. Alerts / advisories / bulletins / notices (and any attachments) referencing Joshua Ben-Asher that were created, received, forwarded, distributed, or posted by BCSO or AOC personnel.
2. For each such alert/advisory/notice: recipient and distribution information, including:
o the To/CC/BCC fields,
o any distribution list (“DL”) names used,
o any routing/forwarding metadata retained,
o and any acknowledgement/read-tracking logs (if maintained).
3. Any records reflecting the creation, modification, or removal of any courthouse security “flag,” caution note, officer safety alert, handling directive, or similar entry associated with Joshua Ben-Asher during this date range, including the text of the entry and any audit/history fields showing who created/edited it.
4. Communications (including emails) between BCSO Court Security and any courthouse/court-facing personnel or offices (to the extent maintained by BCSO) that reference Joshua Ben-Asher, including communications with:
o Bergen County courthouse operations/administration,
o Probation/PSD/child support enforcement offices,
o and/or any court staff acting in an administrative capacity.
5. Communications between any BCSO Court Security and Judge Antoniewicz's or Judge Antoniewicz's chambers.
I also seek these records under the Common Law right of access.
If any portion of this request is denied or records are redacted, please provide the specific statutory basis for each withholding/redaction and produce all reasonably segregable portions. If you contend certain records are not subject to OPRA because they are Judiciary records, please still produce any copies maintained by BCSO and identify what office you believe maintains the record(s).
My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

This request is late. OPRA is a law. Not a choice or a privilege.
You are already being sued by me, in Federal Court. This failure to respond to my OPRA request only makes it worse.
Please produce the requested materials ASAP. I expect them by noon tomorrow.

This response is woefully late. I have received nothing from the BCSD. Compliance with OPRA is your obligation under the law, it is not an option.
A lawsuit has already been filed against Bergen County, in Federal Court. It would be nice to not have to add an OPRA violation to the lawsuit.
