Records Identifying Officials Authorized to Execute Contracts, Reimbursement Agreements, and Other Binding Municipal Instruments

Please accept this correspondence as a request for government records pursuant to the New Jersey Open Public Records Act (“OPRA”), N.J.S.A. 47:1A-1 et seq.
This request has been drafted to identify specific, readily identifiable government records consistent with the requirements set forth in MAG Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N.J. Super. 534 (App. Div. 2005), and the interpretive principles of Mason v. City of Hoboken, 196 N.J. 51 (2008) and Paff v. Township of Galloway, 229 N.J. 340 (2017).
Publicly accessible records indicate that the Borough has previously delegated document-execution authority only through explicit legislative action. For example, the governing body has delegated signing authority to the Fire Chief for firefighter certification documents and to the Tax Assessor for tax-appeal settlement stipulations (Reorganization Resolutions, Jan. 4, 2025).
This request seeks to determine whether any similar delegation exists with respect to the Police Department.
Accordingly, please provide copies of the following government records:
1. Any current in full force and effect ordinance or resolution adopted by the Borough Council authorizing the Chief of Police, or any other Police Department official, to execute, sign, approve, attest, or enter into any category of document, contract, agreement, certification, reimbursement form, settlement, acknowledgment, or binding municipal instrument on behalf of the Borough of Point Pleasant Beach. This includes, without limitation, authority relating to Special Law Enforcement Officer Class I, Special Law Enforcement Officer Class II, Parking Enforcement Officers, or any other law-enforcement or quasi-law-enforcement position requiring execution of training, certification, reimbursement, or employment-related documents.
2. Any current in full force and effect ordinance or resolution adopted by the Borough Council designating which Borough officials are authorized to execute contracts, reimbursement agreements, or other municipal instruments that create a financial obligation for the Borough, impose a reimbursement obligation upon an employee or recruit, acknowledge or incur municipal debt or liability, or otherwise bind the municipality financially. This includes any ordinance or resolution identifying officials authorized to execute employment-related reimbursement agreements of any nature.
3. Any formally adopted and currently operative written policy, including any Standard Operating Procedure, General Order, or comparable policy document, that identifies which Borough officials are authorized to execute, sign, or approve contracts, agreements, certifications, reimbursement forms, or binding municipal documents. This request is limited to final, formally adopted policies and does not include drafts, internal communications, or informal guidance, consistent with relevant determinations issued by the Government Records Council and case law such as Fisher v. Division of Law, 400 N.J. Super. 61 (App. Div. 2008).

1. I certify that I have not been convicted of an indictable offense under the laws of New Jersey, any other state, or the United States.
2. I certify that the government records requested will not be used for commercial purposes.
