Dear H Kim,

Dear Mr./Ms./Mrs. Kim,
The Borough of Leonia (“Borough”) records custodian received your Open
Public Records Act (“OPRA”) request on February 1, 2021. On February 9,
2021, the Borough obtained an extension until March 3, 2021 to respond to
your request. As such, The Borough is timely in responding to your
request.
Your request requires additional time beyond the extension request of
March 3, 2021. OPRA allows custodians to seek extensions of time pursuant
to N.J.S.A. 47:1A-5.i. Specifically, OPRA states that, “the requester
shall be advised by the custodian when the record can be made available.
If the record is not made available by that time, access shall be deemed
denied.` The Borough anticipates requiring an additional week (March 12,
2021) to compile the responsive records in accordance with New Jersey law.
The Borough also reserves the right to request an additional extension of
time, if necessary. See Scheeler v. New Jersey Department of Educ., GRC
Complaint No. 2014-123 (2016).
We appreciate your patience. Thank you for your anticipated cooperation.
Sincerely,
Leonia Borough
