Good afternoon:
I am following-up on the response to your OPRA request.
In regard to the portion of the request for “phone calls”, please be
advised, the Communications Department does not have a responsive record
to provide.
In regard to the portion of the request for bodycam footage, please be
further advised, an extension of time to November 3 is needed in order to
provide the response from the Atlantic City Police Department.

I am following-up on the balance of the response to your OPRA request
(bodycam video).
Please be advised, the Atlantic City Police Department has provided 5
bodycam videos.
1 bodycam video is denied for privacy concerns. See N.J.S.A. 47:1A-1.
A public agency has a responsibility and an obligation to safeguard from
public access a citizen's personal information with which it has been
entrusted when disclosure thereof would violate the citizen's reasonable
expectation of privacy.
See Burnett v. Cnty. of Bergen, 198 N.J. 408 (2009).

Dear Mr. Lax,
Thanks for the videos you sent today, but I will need you to provide all of the videos. You cited "privacy concerns" as the reason for the denial, but this was public meeting with no expectation of privacy. I am respectfully asking you to reconsider this decision and release the video recording you have withheld.
Also, please kindly be advised that you did not respond to the portion of my request for all phone calls to the police department related to this meeting. Please respond accordingly.

Good morning:
In response to your email, please be advised, the bodycam video denied for
privacy concerns does not take place at a public meeting.
The video is outside of the All Wars Memorial Building and features a
minor providing personal identifying information to the police.
Also, please be further advised, the portion of the request for “all phone
calls” was provided on October 20. (Please see attached email).

Dear Mr. Lax,
Thanks, I apologize for the confusion regarding the phone call. I guess I'm just at a loss for why there are no recordings from the meeting. I've seen video of officers inside the meeting, allegedly being asked to remove a board member. Perhaps officers did not activate their cameras for these discussions.
