above referenced OPRA request, which was received by the Custodian of
Records on June 5, 2023.  OPRA requires that a response be provided within
seven days following the date of receipt by the Custodian of Records. 
This response is being sent on the seventh business day following
receipt. 

Your Request Sought Access to the Following Records:

I am writing to request an internal review of Mullica Township's handling
of my OPRA request 'Reconstruction of Seventh Avenue Section #1'

OPRA operates to make public records accessible to the public.  In MAG
Entm’t, LLC v. Div. of Alcohol Beverage Control , 375 N.J. Super. 534
(App. Div. 2005) the Court held that “[u]under OPRA, agencies are required
to disclose only identifiable government records not otherwise exempt…”. 
The MAG Court also held that OPRA does not mandate open ended searches of
an agencies files.  The request fails to state what record or records are
being requested.  If you could provide clarification as to what you are
seeking. 

To the extent that the request seeks a prior OPRA request filed by Maddie
Moore, the Township did review OPRA requests for the year 2023 and found
no requests from Maddie Moore.    

If your request for access to a government record has been denied, you
have a right to challenge the decision by the Township of Mullica to deny
access. At your option, you may either institute a proceeding in the
Superior Court of New Jersey or file a complaint with the Government
Records Council (GRC) by completing the Denial of Access Complaint Form.
