To the Custodian of Records:
Pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq.,
and my right of access to records
concerning myself, I request copies of the following records concerning me,
Richard Toelk (also known as
Richard Donato), DOB 06/26/1968, from my detention at the Atlantic County
Justice Facility during 2023 [insert the
specific booking and release dates if known]:
1. My booking / intake and release records for that detention.
2. All incident reports, unusual-incident reports, medical-emergency reports,
and use-of-force reports
involving me during that detention.
3. All records of any off-site hospitalization, ambulance / EMS call, or
emergency medical transport of me
during that detention.
4. My housing and classification records.
5. Any grievances or medical-request ("sick call") slips I submitted.
6. The name of, and the contract with, the entity that provided inmate medical /
health services at the facility
during that period.
To the extent any responsive record is withheld as a medical record or otherwise
exempt, please identify the
record and the specific statutory basis for the withholding. I am separately
submitting a signed HIPAA
authorization to the facility's medical provider for my medical chart.
Please advise of any anticipated fees before processing. I can receive records
electronically at the email address
above, and I appreciate your response within the seven (7) business days
provided by OPRA.
