Further, please be advised that portions of your request seek information,
not a specific government record. OPRA is a records law, not an
“information” law. “The statute ‘only allows requests for records, not
requests for information’.” Burke v. Brandes, 429 N.J. Super. 169, 555
(App. Div. 2012) (citing Bent v. Twp. of Stafford Police Dep’t, 381 N.J.
Super. 30, 37 (App. Div. 2005)). Because portions of your request seek
information and do not identify a specific government record, it is an
invalid OPRA request and therefore those portions will likely be denied.
You may wish to contact the Board directly to inquire about that
information, if in fact that it exists.

Dear New Jersey Division of Consumer Affairs, State Board of Mortuary
Science,  Maria A. Rojas Letchford,

Please accept this electronic request for public records made under OPRA
and the common law right of access.  I am not required to fill out an
official form or use a particular software platform to submit my request
per NJSA 47:1A-6(f), which states that an email from a requestor including
all of the information required on the adopted form shall suffice in place
of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New
Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:
1. Policy’s and Procedures in “Random Audits” of licensed practitioners of
Mortuary Science.
2. The dates of the last 3 audits.
 A. Name/s of who conducted the audits and location/s in which they
occurred.
 B. Method of how licensee’s were selected. Computer generated, manual
(lottery balls, key rings etc).
 C. Number of licensee’s selected. Percentage of all licensees selected in
relation to total number licensed in the state of New Jersey.
 D. Race of licensee’s selected.
 E. Gender of licensee’s selected.
 F. Name of employer where the audited licensee is employed or was at time
of audit.

My preferred delivery method for response(s) to this request is by E-mail
as attachments.  Please confirm you have received this request.  If you
are not the custodian of records, please forward my request to that person
and provide their email address to me for future reference.
