Prostitution arrests
Dear Seaside Heights Borough,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

All police reports relating to prostitution arrests from January 1, 2026 to May 5, 2026.
My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

This office is in receipt of your OPRA request seeking:
“All police reports relating to prostitution arrests from January 1, 2026 to May 5, 2026.”
At this time, your request cannot be processed as submitted because it does not identify specific government records and would require the Borough to conduct research and analyze files in order to determine which records may be responsive. OPRA is intended to provide access to identifiable government records and does not require a public agency to conduct research, create lists, or analyze records in response to a request.
Specifically, your request seeks all reports “relating to prostitution arrests,” which would require the Police Department to review and interpret records to determine which incidents, charges, or investigations may fall within that category.
Please submit a revised request identifying specific identifiable government records with reasonable clarity so that this office may properly process your request pursuant to OPRA.

My request is not overly broad. I have identified a specific time frame and a specific offense. I would like a copy of all reports for arrests for prostitution from January 1, 2026 to the present. If you are unable to provide these reports based upon the information I have given, please provide a list of all arrests from January 1, 2026 to May 5, 2026.

This office is in receipt of your follow-up correspondence regarding your OPRA request.
The Borough maintains its position that your request, as presently submitted, does not identify specific government records with sufficient clarity and would require research and analysis by the Police Department to determine which reports may be responsive. Specifically, the request requires the agency to identify and determine which incidents, charges, investigations, or arrests fall within the category of “prostitution arrests.”
Additionally, your alternative request seeking “a list of all arrests” from January 1, 2026 through May 5, 2026 would require the creation of a new record or compilation of information if no such list currently exists. OPRA does not require a public agency to create records, perform research, or compile information in response to a request.
If you are seeking a specific identifiable police report, complaint-summons, incident report, CAD report, or arrest record, please provide sufficient identifying information so that the requested government records may be located and reviewed pursuant to OPRA.
