Dear Howell Township,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:

Tax Delinquent
- A list of all property addresses that have an unpaid property tax bill
for the last 12 months. Please also include in the list or separately a
list of properties whose property tax bill was liened against the
property.

Please include the amount owed, and the name of the property owner.

Water Shut Off / Utility Liens
- A list of all property addresses that have had their water bill liened
against the property, have failed to pay their water bill, or have had the
water shut off at any point in the last 12 months.

Please include the amount owed, and the name of the property owner.

Vacant properties.

- Excel Listing of Vacant Houses with Property Address, Property Owner Name and Mailing Address, and any Other Contact Information you have available.

Code violations
- A list of all property with code violations from the past 12 months.

Please include the owner information, phone number, and the nature of the violation.

The official Records Custodian for the Township of Howell, received your
OPRA request on May 22, 2024. As such, the seven (7) business day deadline
to respond to your request is June 4, 2024.

 

Your request requires additional time beyond the seven (7) business days
to fulfill. OPRA allows custodians to seek extensions of time pursuant to
N.J.S.A. 47: IA-5.i. Specifically, OPRA states that, "the requestor shall
be advised by the custodian when the record can be made available. If the
record is not made available by that time, access shall be deemed denied.

Your request requires an extension of time until June 25, 2024.

 

If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Township of Howell to deny access.
At your option, you may either institute a proceeding in the Superior
Court of New Jersey or file a complaint with the Government Records
Council (GRC) by completing the Denial of Access Complaint Form. You may
contact the GRC by toll-free telephone at 866-850-0511, by mail at P.O.
Box 819, Trenton, NJ, 08625, by e-mail at [email address], or at their
web site at www.state.nj.us/grc. The GRC can also answer other questions
about the law. All questions regarding complaints filed in Superior Court

Attached is the Code Violations requested. Please see attached RVP list.
Attached please find a delinquent list and liens list from the Tax
Collector’s Office  Please note that figures due are not to date and if
there is interest in accurate figures contact the Tax Collector’s Office
at (732)938-4500 Ext. 4333 or Ext. 4367. Please note  property address,
property owner’s name, mailing address, contact information  or nature of
the violations were not provided as per N.J.S.A. 47:1A-1. Please see
below.

 

“A public agency has a responsibility and an obligation to safeguard from
public access a citizen’s personal information with which it has been
entrusted when disclosure would violate the citizen’s reasonable
expectation of privacy. See N.J.S.A. 47:1A-1. The New Jersey Appellate has
held that home addresses contained in records do not directly relate to
the ‘core concern’ of OPRA, which is to allow citizens access to records
pertaining to the transaction of government business. See Wolosky v.
Somerset Cty., et al., Docket No. A-1024-15T4 (March 30, 2107). Therefore,
since the home addresses constitute sensitive personal information not
related to a core concern of OPRA, they have been redacted.”

 

As per N.J.S.A. 2C:20-31.1 ( c) and N.J.S.A.  56:8-166.1 (a ) (2)
(Daniel’s Law) property addresses were not provided. The Statutes have
been included for the code violations associated with each Block and Lot
provided.
