As to the portion of your request "and any associated
documents", you must specifically identify the documents
you are seeking pursuant to MAG Entertainment v. Division
of Alcohol and Beverage Control (372 N.J. Super. 534),
wherein the Court stated that “[u]nder OPRA, agencies are
required to disclose only ‘identifiable’ government
records.  Accordingly, please clarify your request with
more specificity so that we can identify what documents may
be responsive.

The Surrogate’s Office is a branch of the judiciary as the
Surrogate serves as both Judge and Clerk of the Surrogate’s
Court and Deputy Clerk for the Superior Court Chancery
Division, Probate Part. As such records kept by the
Surrogate are judiciary records and subject to Rules of
Court and not subject to OPRA. See, N.J.S.A. 47:1A-1 to 13
and 11/30/23 Memo from Glenn A. Grant, Administrative
Director of the Courts. 

This message hereby completes the County's response to your
request. Please be advised that if you feel this response
has not been appropriate, you have the right to pursue a
claim within 45 days with the Government Records Council or
by filing suit in the Superior Court of New Jersey.
