The total number of ICU patients and regular hospital floor patients staying at hospitals separated by hospital (ex. Total ICU patients at Hackensack Meridian Health on March 8, 2020) (Ex. Total regular hospital floor patients at Morristown Medical Center on February 14, 2020) by day beginning January 1, 2020 and ending on May 30, 2020.

The total number of patients discharged at hospitals separated by hospital (Ex. Total patients discharged from Robert Wood Johnson University Hospital on April 7, 2020) by day beginning January 1, 2020 and ending on May 30, 2020.

The total capacity of each hospital in New Jersey by total bed capacity and ICU capacity separated by hospital (Ex. Total bed capacity at Bergen New Bridge Medical Center on April 23, 2020) (Ex. Total ICU capacity at Virtua Health & Wellness Center - Camden on May 24, 2020) by day beginning January 1, 2020 and ending on May30, 2020.

This responds to the referenced request for government records.

 

The request is improper in that it seeks information rather than a
specific government record.  Therefore, the government records law,
N.J.S.A 47:1A-1 et seq., obliges me to deny the request.  Without waiving
this and other available objections, and in an effort to assist you, we
advise as follows.

 

With respect to the first two items of the request, relating to hospital's
daily patient censuses and discharges, if the request is meant to ask for
records submitted pursuant to Executive Order No. 111 (Governor Murphy,
2020), those records are exempt from disclosure pursuant to the Emergency
Health Powers Act at N.J.S.A. 26:13-26, and N.J.A.C. 13:1E-3.2(a)5, except
as may be posted to the Data Dashboard at

as thus provided, the Division of Epidemiology, Environmental, and
Occupational Health does not hold government records responsive to the
first two items of the request.  Neither the Division, nor the Department
generally, routinely receives daily hospital census or discharge figures
during periods of regular operations, that is, in the absence of a public
health emergency.

 

With respect to the third item of the request, relating to hospitals' bed
capacities, each hospital's licensed bed capacity for purposes of regular
operations, that is, in the absence of a public health emergency, is
available within the details of each facility's licensure (certificate of
need) status page on the website at 
[2]https://nj.gov/health/healthfacilities/ (select “Find Hospitals or
Outpatient Facilities” and then enter facility name).  

 

The Commissioner of Health has issued certain Executive Directives in
response to the ongoing public health emergency, available
at [3]https://www.nj.gov/health/legal/covid19/.  One or more of these
Executive Directives might authorize licensed healthcare facilities to
apply for temporary modifications of their respective authorized
capacities, on a case-by-case basis, to enhance their abilities to respond
to the public health emergency.  See, for example, ED 20-008:
Authorization for Health Care Facilities to Add Ventilator Beds (April 14,
2020).  The Division does not hold records relating to these certificate
of need and licensure matters.
