Policy for take home municipal vehicles

Dear South Plainfield Police Department,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

Pursuant to the New Jersey Open Public Records Act (N.J.S.A. 47:1A-1 et seq.), I request copies of all current and previously effective Borough and /or Police Department written policies, directives, general orders, special orders, standard operating procedures (SOPs), administrative orders, rules, manuals, or other written guidance governing the assignment, operation, use, maintenance, monitoring, and return of municipally owned take-home vehicles for Borough employees in effect at any time from January 1, 2022 through December 31, 2026.

This request includes, but is not limited to, policies or directives addressing:

* Eligibility for assignment of take-home vehicles;
* Authorized and unauthorized use;
* Personal use of take-home vehicles;
* Commuting and geographic restrictions;
* Fuel usage and fuel cards;
* EZPass transponder use and toll reimbursement;
* Vehicle maintenance and service requirements;
* Mileage reporting or odometer documentation;
* Vehicle inspections;
* Vehicle reassignment, transfer, replacement, or return upon issuance of a new vehicle; and
* Recordkeeping requirements relating to municipally assigned take-home vehicles.

This request seeks only existing government records and does not require the creation of a new record.

If any responsive record is withheld or redacted, please identify the specific record withheld or redacted, cite the specific statutory exemption authorizing the withholding or redaction, and provide the factual basis supporting the claimed exemption.

The statutory deadline for responding to this OPRA request has passed without a response. As a result, I have filed a Denial of Access Complaint with the Government Records Council. If the Borough wishes to resolve this matter by producing the requested records or otherwise addressing the request, I remain willing to consider such a resolution.
