Records requested:
Polices, procedures, and public facing statements directed to SBIG program applicants that the applicant businesses must, during the pendancy of the application review by the NJEDA, verify the number of employees of each ethnicity working for contractors hired by applicant and/or applicant's landlords.

Requestor seeks any records of the SBIG program that explain or otherwise outline why an applicant small buisness must police the employment practices of contractors and/or ascertain the ethnicity of all the contractor's employees as a part of the SBIG grant review process. Records that explain how such information is relecant to the applicant and/or is factored into the merit of the SBIG applicant is requested.

Records that explain why the NJEDA expects an applicant business, prior to an award, to do the job of the New Jersey Department of Labor or Civil Rights is further requested.

Under common law, a purpose statement is required. The NJEDA is requesting documents about the ethnicity of employees of contractors hire perform work for the benefit of the applicant. The documents seek the ethnicit of the contractor's employees but not the applicant. The public has a right to know why SBIG applicants are burndened with providing the NJEDA information concerning a third party, taking place prior to a grant award, and that has no bearing on the small business or its SBIG application and is not at all in the applicant's control.
