Pursuant to OPRA Request 127-18, you have requested information, and not a
specific public record. This is not a valid OPRA Request. Please
identify a record. OPRA deals with requests for existing public records,
not for the Custodian of Records to create a record.
OPRA defines a government record as a record "made, maintained or kept on
file . . . or that has been received in the course of . . . official
business . . ." N.J.S.A. 47:1A-1.1. Also, OPRA requires a custodian to
grant or deny access as soon as possible but no later than seven (7)
business days from receipt of the request. N.J.S.A. 47:1A-5(i). OPRA
further requires that custodians inform requestors of the lawful basis for
any denial of government records. N.J.S.A. 47:1A-6.
If a request does not name specifically identifiable records or is overly
broad, a custodian may deny access pursuant to the following court
decisions: MAG Entertainment, LLC v. Division of Alcoholic Beverage
Control, 375 N.J.Super. 534 (App. Div. 2005), Bent v. Stafford Police
Department, 381 N.J. Super. 30 (App. Div. 2005), New Jersey Builders
Association v. New Jersey Council on Affordable Housing, 390 N.J. Super.
166 (App. Div. 2007), and Schuler v. Borough of Bloomsbury, GRC Complaint
No. 2007-151 (February 2009). Requestors shall identify types of records,
dates, parties to correspondence, subject matter, etc. A custodian is
obligated to search their files to find the identifiable government
records listed in the complainant’s OPRA request. A custodian is not
required to research their files to figure out which records, if any,
might be responsive to a broad and unclear OPRA request.
You may resubmit an OPRA Form and request a specific document.
