Mr. Weiner:
The records you seek are the subject of an ongoing investigation.
Pursuant to N.J.S.A. 47:1A-3(a), records pertaining to an “investigation
in progress” are exempt from disclosure under OPRA where “the inspection,
copying or examination of such record or records shall be inimical to the
public interest.”
The City has confirmed with the investigating agency, the Hudson County
Prosecutor's Office, that making the records that you seek public would
tend to impede a thorough, fair and impartial investigation of the subject
matter of your request. Accordingly, release would be inimical to the
public interest.
Further, one Investigation Report that we found is a criminal
investigatory record, which is exempt from disclosure under N.J.S.A.
47:1A-1.1.
Finally, there is no responsive CCTV footage regardless.
Accordingly, there are no non-exempt records that we can produce and your
request is being closed.
If you wish to continue to seek access to these records, you will be best
served directing any future communications to the Hudson County
Prosecutor's Office, 201-795-6400, as they are most familiar with the
status of their own investigation.
Best regards,
Jeremy Jacobsen, Esq.
