Please note that redactions to the above have been made pursuant to
N.J.S.A. 47:1A-1 which states, “a public agency has a responsibility and
an obligation to safeguard from public access a citizen’s personal
information with which it has been entrusted when disclosure thereof would
violate the citizen’s reasonable expectation of privacy” and/or N.J.S.A.
52:17C-10(a) which limits disclosure of 9-1-1 subscriber information to
that used for the “purpose of responding to emergency calls or for the
investigation of false or intentionally misleading reports of incidents
requiring emergency service.”
Unfortunately, your request also contained broad and/or vague language
including the catch-all phrase(s): "forms" and "all records
available" which fail to identify specific records, as is required for a
valid OPRA request.
Please be advised that “[t]he purpose of OPRA ‘is to make identifiable
[non-exempt] government records 'readily accessible for inspection,
copying, or examination’.” Jersey Builders Ass’n v. New Jersey Council on
Affordable Housing, 390 N.J. Super. 166, 176 (App. Div. 2007). “OPRA does
not countenance open-ended searches of an agency's files.” MAG, supra. 375
N.J. Super. at 549. “A party requesting access to a public record must
specifically describe the document sought.” Bent v. Stafford Twp., 381
N.J. Super. 30, 37 (App. Div. 2005).
The City has provided here those records that were sufficiently
identifiable under OPRA, namely the police reports. If you wish to have
other records, you are free to submit separate requests more precisely
specifying the types of records you seek.
