We're waiting for Anonymous to read recent responses and update the status.

Dear Anonymous,

The Clark Police Department received your Open Public Records Act (OPRA)
request on December 18, 2023.

The official Records Custodian, Joann Concina received your OPRA request
on December 19, 2023.

As such, the seven (7) business day deadline to respond to your request is
December 29, 2023. 

This response to your request is being provided to you on the second
business day after the custodian’s receipt of said request.   

 

Your OPRA request sought access to the following: 

"All police incident reports and C.A.D. reports for all police actions
that occurred at 809 Featherbed Lane Clark, NJ 07066 from 11-1-23 to
12-15-23."  

There are 2 reports responsive to your request.

 1. The attached CAD report #23-29551 requested is being provided by email
and is responsive to your request. Please see attachment. 

 2. A second report is being denied based on N.J.S.A. 47:1A-1 (Legislative
Findings)

     Privacy Interest - “a public agency has a responsibility and an
obligation to safeguard from public access a citizen's personal
information with which it      has been entrusted when disclosure thereof
would violate the citizen's reasonable expectation of privacy.” See
Burnett v. Cnty. of Bergen, 198 N.J. 408              (2009).

 If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Clark Police Department to deny
access. At your option, you may either institute a proceeding in the
Superior Court of New Jersey or file a complaint with the Government
Records Council (GRC) by completing the Denial of Access Complaint Form.
