Dear Alexander Tortorella,
The Point Pleasant Beach Police Department received your OPRA request on
April 24, 2023. As such, this response to your request is being provided
to you on the 3^rd business day after our receipt of your request. You
requested: Police Report # 22PP25986 and accompanying body camera footage.
Your request is denied to the extent it seeks informal complaints among
neighboring property owners. Disclosure of such information from a
complaining witness would violate the citizen's reasonable expectation of
privacy pursuant to N.J.S.A 47:1A-1. See Wilcox v. Township of West
Caldwell, GRC Complaint No. 2004-28 (October 2004)(portions of records
revealing the citizen who informed the Township of a zoning violation
relating to the OPRA Complainant’s property were properly redacted. “The
Complainant’s stated need for access does not outweigh the citizen’s
expectation of privacy. Disclosure of said information could result in
unsolicited contact and confrontation between the citizen and the OPRA
complainant and/or its agents or representatives.”); Giannakis v. New
Jersey Department of Education, GRC Complaint No. 2012-152 (May
2013)(Disclosure of anonymous complainant’s name related to unfounded
complaint would violate citizen’s expectation of privacy).
