Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I respectfully challenge the denial of my OPRA request dated May 12, 2026.

The response states only that “this is an active investigation” and denies the request in full. However, N.J.S.A. 47:1A-3(a) does not authorize a blanket denial of all requested records merely because an investigation is active. OPRA requires the custodian to identify the specific records withheld and the specific statutory exemption applicable to each withheld record or category of records.

Additionally, OPRA requires disclosure of non-exempt portions of responsive records through appropriate redaction where feasible. Please advise which specific records are being withheld in full, which records can be released with redactions, and the precise legal basis for each denial.

Please also clarify whether the agency conducted searches of:

CAD records,
Spillman RMS/Flex,
Master Name Index records,
linked incident reports,
dispatch logs,
and officer activity logs responsive to the search parameters provided.

To the extent any responsive records constitute required “criminal investigatory records,” please identify whether any portion nevertheless contains disclosable information under OPRA, including but not limited to:

date,
time,
location,
type of incident,
arrest information,
booking information,
complaint number,
and dispatch metadata.

I further request production of any segregable non-investigatory records, including CAD dispatch records responsive to the officer/date search request for PTLM A. Badalmenti #135 on May 9–10, 2026.

If records are withheld, please provide a detailed index identifying:

the record type,
date,
general subject matter,
statutory exemption claimed,
and whether partial disclosure was considered.

Dear Bradley Beach Borough,

I am writing to request an internal review of Bradley Beach Borough's handling of my OPRA request 'Police Records'.
