Dear Adams, Ann,

Saying all police records are criminal investigatory records is not correct. If investigations are happening now you are correct but if they are close you must release. You used 1A-1.1 as your objection please see 1A-3.b which says you must release if an arrest has been made, information as to the defendant's name, age, residence, occupation, marital status and similar background information and, the identity of the complaining party unless the release of such information is contrary to existing law or court rule; information as to the text of any charges such as the complaint, accusation and indictment unless sealed by the court or unless the release of such information is contrary to existing law or court rule; information as to the identity of the investigating and arresting personnel and agency and the length of the investigation; information of the circumstances immediately surrounding the arrest, including but not limited to the time and place of the arrest, resistance, if any, pursuit, possession and nature and use of weapons and ammunition by the suspect and by the police; and information as to circumstances surrounding bail, whether it was posted and the amount thereof. Your argument is also not correct because not all police records criminal investigatory records. Noise complaints, arguments with landlords neighbors an other people, traffic stops or accidents where no arrest happened, borough ordinance violations, parking tickets are a few police matters that are not criminal investigations. The number of times a person interacted with your borough police is also not a criminal investigatory record.

My name is Lynn Sweeney and I am the City Clerk and Records Custodian for the City of Brigantine. I received both your and Ms. Felix's responses to your OPRA request dated March 31, 2022. I spoke with the City Solicitor Fred Scerni this afternoon and he will personally retrieve all records for the time frame specified. His team will review all of the records and give to you all information that can legally be released. I promise to have an answer for you no later than April 19, 2022. I'm sorry if there was any confusion.
