You are claiming that no recording of the phone calls exist ? The officer said that the conversation was being recorded . Was the recording destroyed? no recording was made? What is it?

With regards to phone calls note the request is overly broad by “recordings made to the police by the public”. Provide the specific event/call in question and same will be reviewed to check for existence, redacted (if/where appropriate), and provided if releasable at the cost generated.

Recordings of phone calls made to the howell police department dispatcher. The administration number non emergency number. I gave you a specific time frame , that is not overly broad. Those recordings exist a limited number of phone calls at this specific time frame were made to the howell police department's administration phone number by the public. They were answered by the dispatcher recordings were made. If 20 recordings were made by the police department in that specific time frame I want all 20. All recordings . If these records that do exist are exempt then please provide the specific exemption in law.

Dear Donna Belton,

I request that the easily transferred files that can be easily demonstrated to be easily transferred the .wav file these records are most likely in. The electronic file this records is already in. Be transmitted to me , in this format. Sending me to the police station to get files easily transmitted electronically during a pandemic is completely unreasonable , unnecessary. Irresponsible and cruel You have shown that html files and data can and has been transferred to me here in this format. A sound file is no different. It not extensive it's a simple request.

Records should be sent in the format the requestor has asked for. It can be shown that other towns easily have done this. The record is already in electronic format. And already on a computer. Please comply with this very simple common request. If not please provide the exemption in law you are using to deny this simple request.

OPRA provides that a custodian must permit access to a government record and provide a copy
of the record(s) in the medium requested, if the public agency maintains the record in that
medium. If the custodian does not maintain the record in the medium requested, he/she must:
 Convert the record to the medium requested; or
 Provide the record in some other meaningful medium (meaningful to the requestor).
N.J.S.A. 47:1A-5.d.
If the agency maintains the record in the medium requested, the custodian can only charge the
actual cost of copying (e.g. the cost of the floppy disk or CD-ROM). However, a custodian may
impose a special service charge related to conversion for:
 Extensive use of technology; and
 Labor for programming, clerical and supervisory assistance that may be required.
The special service charge must be based on the cost of the technology and labor actually
incurred. This may include charges incurred by an outside vendor. N.J.S.A. 47:1A-5.c.
Before undertaking any conversion to another medium or taking other major actions that would
result in the imposition of a special charge, the custodian must first inform the requestor that a
special charge will be incurred and give the requestor the opportunity to accept or reject the extra
fee. N.J.S.A. 47:1A-5.c. If the requestor objects to the special charge and refuses to pay it, the
custodian may deny the request for access to the record. However, if the requestor is willing to
pay for it, the agency has the responsibility to provide access to the government record in th
