Dear Weehawken Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.

I am requesting copies of all police records associated with the address 17 Oak Street, Apt 2, Weehawkin, NJ 07086 for the period 1/2007-08/2013, including:
(1) all calls for service or CAD logs listing responses to this address
(2) all incident or offense reports, investigation reports and domestic disturbance reports generated in connection with responses to this address
(3) any arrest reports or summonses issued in connection with incidents at this address.
If any records are withheld or redacted, please identify the legal basis (OPRA exemption or other law) for each redaction or denial.

With respect to your OPRA #114-26 the Township’s response is below:
Good afternoon,
In connection with the above referenced matter and on behalf of the
Township Clerk, please be advised OPRA seeks Domestic Violence reports
which are exempt via OPRA as they are considered classified as per the
Weehawken Police Department. Additionally, please be advised only records
beginning in 2010-2013 are readily accessible and any records sought prior
to 2010 will require an extensive search. Therefore, due to the volume of
your request, the Township will need to assess a special service charge in
connection with for the fulfillment same due to the extraordinary
expenditure of time and effort that will be required to fulfill it. OPRA
allows public agencies to impose a special service charge whenever the
nature, format, manner of collation or volume of a governmental record
embodied in the form of printed matter to be inspected, examined, or
copied pursuant to this section is such that the record cannot be
reproduced by ordinary document copying equipment in ordinary business
size of when fulfilling a request requires an extraordinary expenditure of
time and effort. N.J.S.A. 47:1A-5.c. The Township will assess an
additional special service charge based on the hourly rate of the lowest
level employee capable of fulfilling the copying of the request and may
also include third-party charges if special copying equipment is
required.
In these particular cases the Township’s Police Department estimates it
would take the lowest capable employee approximately (32 hours per year
searched (approximately 30,000 CAD events by hand for years 2007, 2008,
2009) to review and redact the documents you are requesting. That employee
and her salary is listed below, The Township will require you to place a
deposit for the salary of that employee prior to the beginning of the
work. Maria Higgins $40.31 per hour x 96 hours = $3,869.76 (this does not
include mailing and postage fees associated).
The Township will require a deposit of $4,000.00 made payable to the
Township of Weehawken and any overage will be returned to you. The
Township will begin its production of the requested documents upon receipt
of same. Should the Township not receive the deposit or a response that
you are seeking to proceed within (7 days) we will consider the matter
closed and concluded.
