For the period of March 1, 2026 through June 5, 2026, I am requesting electronic copies of the following records maintained by the Borough of Wallington and or the Wallington Police Department Gene Rachelski, Eugene Rachelski, Eugeniusz Rachelski, or any similar spelling or abbreviation of that name, a current Wallington Councilman.
Police reports.
Incident reports.
CAD entries.
Call logs.
Complaint numbers.
Summonses.
Disposition records.
Case numbers.
This request includes, but is not limited to, records concerning alleged removal of campaign signs from private property, alleged photographing or posting about a candidate’s residence, and any related police response, complaint, or call for service during the above date range.
If no police report exists, please provide any record showing whether a call for service, CAD entry, complaint, incident number, or police response was logged.
Please provide all responsive records electronically by email. To the extent responsive records contain personal identifying information, juvenile information, victim information, home addresses, phone numbers, or other exempt information, please redact those portions and provide all reasonably segregable non exempt portions.

The Borough of Wallington received your Open Public Records Act (OPRA) and
Common Law request, internally cataloged as 26-133, on Monday, June 8,
2026. Pursuant to the New Jersey Open Public Records Act (N.J.S.A. 47:1A-1
et seq.), a response is due within seven (7) business days, excluding the
date of receipt. As such, our office is responding within the seven (7)
business day deadline.

“A public agency has a responsibility and an obligation to safeguard from
public access a citizen's personal information with which it has been
entrusted when disclosure thereof would violate the citizen's reasonable
expectation of privacy”
If your request seeks information or asks questions and does not identify
specific government records, same is not a valid OPRA request. When a
request is “complex” because it fails to specifically identify the
documents sought, then that request is not “encompassed” by OPRA. See New
Jersey Builders Association v. New Jersey Council on Affordable Housing,
390 N.J.Super. 166, 180 (App. Div. 2007). A proper request under OPRA
must identify with reasonable clarity those documents that are desired,
and a party cannot satisfy this requirement by simply requesting all of an
agency's documents. See Bent v. Stafford Police Department, 381
N.J.Super. 30, 37 (App. Div. 2005). Custodians are not required to
conduct research or create new records in response to an OPRA request.
