The City of Margate City Records Custodian received your Open Public
Records Act (OPRA) below on August 29, 2023.   This response to your
request is being provided to you on the fifth business day of  the
custodian’s receipt of said request.  A copy of your OPRA is attached
along with available responsive documents to be transmitted. These records
are being transmitted to you via email, as per your request.  Pursuant to
N.J.S.A. 47:1A-5.b., the cost associated with the attached documents is
$0.00.  Per NJSA47:1A-1and Executive Order No. 26 (McGreevey 2002) EMS
report is under HIPPA.

 

Additional Police documentation of the incident is available on a CD.  The
cost for the CD is $5.00 plus shipping of $1.83 if you choose not to pick
the CD up. CD will not be mailed until a check made out to the City of
Margate is received. 

 

If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Margate City Records Custodian to
deny access. At your option, you may either institute a proceeding in the
Superior Court of New Jersey or file a complaint with the Government
Records Council (GRC) by completing the Denial of Access Complaint Form.

This is a request for public records made under OPRA and the common law
right of access. I am not required to fill out an official form. Please
acknowledge receipt of this message.

  Records requested:

 

Any and all Police / EMS reports/CAD entries/BWC/emails/ notes/photographs
from early morning hours of Sat Aug 26, 2023 involving an incident at
Maynard's Cafe. A female patron was removed from the property by EMS and
transported to Shore Memorial Hospital for alcohol possible poisoning.
Please do not include any HIPPA related information regarding the victim /
patient.
