Dear Montclair Township,

Please pass this on to the person who conducts Open Public Records Act reviews.

I am writing to request an internal review of Montclair Township's handling of my OPRA request 'Police Department - Tables of Organization, Employee Rosters/Status, Written Directive System Policy 2019-2024'.

Please and kindly review this request with URGENT PRIORITY.

As you already know, I originally requested, "From January 1, 2019 through January 1, 2024, inclusive" the following records:

1. All FULL AND COMPLETE Montclair Police Department Tables of Organization* including the number of positions per rank, title and assignment. Edits/revisions thereto, dates of edits/revisions, by whom the edit/revision was made, and under whose authority said edit/revision was made.

*This included All full and complete Montclair Police Department Tables of Organization maintained, kept or stored by any/all the Township of Montclair departments and utilities and their divisions. This included, but is not necessarily limited to, Human Resources, the Township Manager, and the Montclair Police Department. All copies were requested.

2. From January 1, 2019 through January 1, 2024, inclusive;

Item #3 appears not to be actively and currently in dispute. Though, I reserve the right to redress this item without any waiver, at any time.

Item #1 IS IN DISPUTE. The Table of Organization for the Montclair Police Department was clearly requested from 1/2019-1/2024. This included, as it does now, but was/is not necessarily limited to, Human Resources, the Township Manager, and the Montclair Police Department. All copies were, and remain requested.

The originally requested records have NOT been provided.

Only 2022 has been provided. Please and kindly provide ALL RECORDS including revisions, as originally requested, immediately.

Item #2 IS ALSO IN DISPUTE. A review of the response has been conducted.

This request was fulfilled. Responsive records were provided
to the extent that they exists. OPRA does not require this
agency to create any new records or answer questions, only to
provide records that exist.

For example, your request for an organizational chart was
provided with the only copy that we have at the police
department. There is no record of changes made, by whom, and
on what date, that can be located. Additionally, the rosters
provided are the published rosters that the records bureau
was able to locate, but there is no record that was located
that includes a list of changes made, by date, and by whom,
unfortunately.

Should you require any further records that are available, or
wish to discuss further, please reach out the Montclair
Police Department Records and Identification Bureau.
