Dear Pennington Borough,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

Any and all video, meeting minutes, executive session minutes, and/or other digital media to include zoom recordings involving Police Chief Douglas Pinelli and his employment status prior to his separation date of 2/1/2025.

This responds to your email of March 5, 2025 pursuant to the Open Public
Records Act (“OPRA”).
You request: “Any and all video, meeting minutes, executive session
minutes, and/or
other digital media to include zoom recordings
involving Police Chief Douglas Pinelli
and his employment status prior to his separation
date of 2/1/2025."
We must deny your request for the following reasons under OPRA:
1. The request pertains to records of deliberations by Borough Council
in executive session closed to the public under the Open Public Meetings
Act. The definition of “government record” under NJSA 47:1A-1.1 expressly
excludes from the definition intra-agency deliberative material.
2. The records requested are personnel records. NJSA 47:1A-10
provides that the personnel records of any individual in the possession of
a public agency are not a government record and shall not be made
available for public access (with exceptions not applicable here).
Please note in addition that the form of your request is solely
in the name of a fictitious entity without the name of any responsible
individual or any mailing address. In these circumstances, in accordance
with NJSA 47:1A-5.f, 47:1A-6 and 47:1A-7.1, the Borough reserves its right
to object to any proceeding intended to contest this determination.
