Dear Pompton Lakes Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

This OPRA seeks Chief Derek Clark’s retirement letter/email to Borough Administrator Michael Carelli as referenced in the June 11, 2025 closed meeting minutes of the Pompton Lakes borough council, and any related emails or letters recommending Captain Anthony Rodriguez as OIC, whether sent to Mr. Michael Carelli or any other borough employee or council member.

I seek this responsive document(s) though a Pompton Lakes Borough response to a July 1, 2025 Debbie P. OPRA claimed there were no responsive documents to a similar query asking for:

“…communications regarding Chief Derek Clark’s retirement, including discussion of potential dates, notice of intent to retire, the borough’s acceptance of said retirement, and communications regarding an exit contract, and said exit contract.”

I request the specific letter/email(s) as mentioned above in the closed meeting minutes, and any communications or discussions regarding the retirement date and any exit contract. (Resolution 25-79 was already shared to the OPRA site in response to a portion of Debbie P.’s query and I am not seeking this document as part of the response.)
