Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

This email is in regards to the Open Public Records Act (OPRA) request

The OPRA request sought access to the following:

covering the period of 2025 and prior/beyond.

 

I am also seeking all Memorandums of Agreement (MOA) between the Borough
of Middlesex and the Middlesex Superior Officers Association for
collective negotiations agreements (CNAs) covering the period of 2025 and
beyond.

 

Currently, your request fails to identify with reasonable clarity the
specific government records sought, as is required by Bent v. Stafford
Police Department, 381 N.J.Super. 30, 37 (App. Div. 2005). At this time,
we request clarification of your OPRA request. Please respond by email to

records sought so that we may process your request. Failure to respond in
writing within the next seven (7) business days may result in the closure
of your OPRA request.

 

Please note the following comment(s) from the Custodian of Records:

When a request does not name specifically identifiable records or is
overly broad, a custodian may deny access pursuant to the following court
decisions:  MAG Entertainment, LLC v. Division of Alcoholic Beverage
Control, 375 N.J.Super. 534 (App. Div. 2005).  A proper request under OPRA
must identify with reasonable clarity those documents sought.  A custodian
is obligated to search and find the identifiable government records listed
in the Complainant`s OPRA request. A custodian is not required to research
her files to figure out which records, if any, might be responsive to a

Dear Kelsey Meixner,

There was nothing unclear about my request and it did not fail to identify specific government records.

I specifically requested a collective bargaining agreement which is a contract and any memorandums of agreement between the Borough of Middlesex and the police union for which the supervisors are members of. Specific timeframes were also provided to help narrow the request.

Please provide all current collective bargaining agreements (aka contracts) and memorandums of agreement (MOAs) between police unions representing the Middlesex Borough police officers and supervisors and the Borough of Middlesex.

Failure to provide the specific requested records will result in further action with the GRC and Superior court.
