I checked with the Town of Newton’s legal counsel on the matter we
discussed on referring OPRA requests for police records to the Police
Department.  They advise my approach is fully compliant with OPRA. 

 

They state:

From our review, it is our opinion that your approach is fully compliant
with OPRA. Resolution #302-2024 properly designates the Lieutenant of the
Operations Division as Deputy Custodian of Public Records for all matters
involving the Police Department. The Government Records Council has
expressly recognized this practice, specifically stating in its Handbook
for Records Custodians:

 

“OPRA does not preclude a municipality from developing reasonable and
practical measures for responding to OPRA requests, which may include the
designation of deputy custodians for particular types of records (most
common occurrence is the Police Department).”

 

Further, under N.J.S.A. 47:1A-5(h), when a request is received by someone
who is not the designated custodian, that person may either forward the
request or direct the requestor to the appropriate custodian. Directing
requesters of police records to the Police Department (via the online form
and [1][email address]) is therefore lawful and appropriate under
the law. This also ensures the seven-business-day response clock begins
when the request reaches the Deputy Custodian who maintains those records.
