Dear Seaside Heights Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

Records requested: Dispatch CAD phone call audio and police narrative for welfare check phone call made by Kelly Green on February 10 or 11, 2025 on John Yates at 203 Dupont Avenue, Seaside Heights, New Jersey. She made a phone call when Mr. Yates was threatening to harm himself with kitchen knives. It is possible that she requested to be an anonymous caller.

My preferred delivery method for response(s) to this request is by E-mail as attachments. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

The Borough of Seaside Heights received your OPRA request
As you may be aware, P.L. 2024 c. 16, adopting amendments to the Open
Public Records Act, became effective 9/3/2024.  As such, the Borough of
Seaside Heights has updated the OPRA Request form which can be located
online at website  [1]https://www.seaside-heightsnj.org/
 
This new legislation requires a requestor to certify to the following
items prior to a request being processed:
 
Under penalty of N.J.S.A. 2C:28-3, I certify that:
 
1. I HAVE / HAVE NOT (select one) been convicted of any indictable offense
under the laws of New Jersey, any other state, or the United States; 
2. I, or another person, WILL / WILL NOT (select one) use the requested
government records for a commercial purpose; and
3. I AM / AM NOT (select one) seeking records in connection with a legal
proceeding.
 
Kindly submit your certifications or a completed and signed OPRA form to
this Office by close of business on 7 business days, so that we may
proceed accordingly, or your request will be considered withdrawn and
closed.
