Dear Mr. Guenther,

The Borough of Seaside Park is in receipt of your OPRA request for “copies
of all meeting minutes for all closed sessions of the Borough Council
regarding Kenneth Guenther.” Please be advised this request is overly
broad.

 OPRA is not intended as a research tool to “force government officials to
identify and siphon useful information. Rather, OPRA simply operates to
make identifiable government records ‘readily accessible for inspection,
copying, or examination.’ MAG Entertainment, LLC v. Division of Alcoholic
Beverage Control, 375 N.J. Super. 534, 546 (App. Div. 2005). Under OPRA,
agencies are required to disclose only ‘identifiable’ government records
not otherwise exempt. OPRA does not countenance open-ended searches of an
agency's files.

A requestor must specifically describe the document sought. Bent v.
Stafford Police Department, 381 N.J. Super. 30, 37 (App. Div. 2005). “As
such, a proper request under OPRA must identify with reasonable clarity
those documents that are desired, and a party cannot satisfy this
requirement by simply requesting all of an agency's documents.”

Fulfillment of your request as currently worded would require research on
behalf of the Clerk. Please clarify your request, specifying the dates of
the meetings for which you would like the minutes provided
