The response to my OPRA request should have been filled by February 25th and is now nearly a month overdue. I have received no response or reason for the delay.

I received your Open Public Records Act (OPRA) request on March 25, 2020 for:

1. All long term tax exemption (Payment in Lieu of Taxes aka "PILOT") agreements currently in effect, including 220 and 230 West Crescent Avenue
2. Any analytical or economic reports that were issued on these agreements

As such, the seventh (7th) business day deadline to respond to your request is April 3, 2020. This request requires additional time to fulfill due to the current COVID-19 pandemic and multiple employees working remotely. OPRA allows custodians to seek extensions of time pursuant to N.J.S.A. 47:1A-5.i. Specifically, OPRA states that, “the requestor shall be advised by the custodian when the record can be made available. If the record is not made available by that time, access shall be deemed denied.” This request requires an extension of time until April 10, 2020.

If your request for access to a government record has been denied or unfilled within the seven (7) business days required by law, you have a right to challenge the decision by the Borough of Allendale to deny access. At your option, you may either institute a proceeding in the Superior Court of New Jersey or file a complaint with the Government Records Council (GRC) by completing the Denial of Access Complaint Form. You may contact the GRC by toll-free telephone at 866-850-0511, by mail at P.O. Box 819, Trenton, NJ, 08625, by e-mail at [email address], or at their web site at www.state.nj.us/grc. The GRC can also answer other questions about the law. All questions regarding complaints filed in Superior Court should be directed to the Court Clerk in your County.

The Borough of Allendale received your Open Public Records Act (OPRA)
request on March 25, 2020 for:

1.            All long term tax exemption (Payment in Lieu of Taxes aka
"PILOT") agreements currently in effect, including 220 and 230 West
Crescent Avenue

2.            Any analytical or economic reports that were issued on these
agreements

 

As such, the seventh (7th) business day deadline to respond to your
request was April 3, 2020. This request required additional time to
fulfill due to the current COVID-19 pandemic with multiple employees
working remotely and very limited access to records. OPRA allows
custodians to seek extensions of time pursuant to N.J.S.A. 47:1A-5.i.
Specifically, OPRA states that, “the requestor shall be advised by the
custodian when the record can be made available. If the record is not made
available by that time, access shall be deemed denied.” Due to the ongoing
declared public health and state of emergency, this OPRA request required
several extensions of time to fulfill.  The latest extension sought was
until June 1, 2020.

 

The following records were provided to you on April 8, 2020 and were
responsive to Item No. 2 of your request:

The following records, attached hereto, are responsive to Item No. 1 of
your request:

Lot 10.01 dated April 27, 2009 and Borough of Allendale Resolution 09-175
dated April 23, 2009 (5 pages)

2.            PILOT Agreement with Allendale Housing, Inc. for Block 904,
Lot 14 dated October 9, 2009 and Borough of Allendale Resolution 09-350
dated October 8, 2009 (5 pages)

3.            PILOT Agreement with Allendale, Housing, Inc. for Block 904,
Various Lots dated May 23, 2011 and Borough of Allendale Resolution 11-171
dated May 12, 2011 (4 pages)  

 

As previously advised in writing on April 30, 2020, there is no PILOT
agreement in effect for 220/230 West Crescent Avenue.
