Petitions
Dear Keansburg Borough,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
Please can the municipal clerk provide the completed petitions with signatures for the candidates filled for the May 14, 2024 non-partisan municipal election?
Yours faithfully,
Watchful Citizen
Dear Watchful Citizen,
We would be happy to provide you with the Petitions received for the 2024 Municipal Election.
Unfortunately, in order to provide them electronically, there will be a cost of approximately $38.42, which would have to be paid in advance.
Alternatively, we can offer you the opportunity to inspect the Petitions in person at no cost to you. We will simply set an appointment for you to come to Borough Hall to inspect the documents.
Please advise which option you would prefer. If you have any questions, please feel free to call me directly at 732-787-0215 x112.
Very truly yours,
Jo-Ann O'Brien

Dear Jo-Ann O'Brien,
Thank you for your response, however as per statute NJSA 47:1A-5b, "...Access to electronic records and non-printed materials shall be provided free of charge, but the public agency may charge for the actual costs of any needed supplies such as computer discs."
Again, my request is simply for electronic copies (pdfs) of the petitions filed for the 2024 May Municipal Non-Partisan elections in Keansburg.
I look forward to your response and this request being fulfilled.
Yours sincerely,
Watchful Citizen
Dear Watchful Citizen,
I do understand OPRA requirements as per NJSA 47:1A-5b and I do not assess a charge to anyone lightly. The records you have requested are physical documents. The petitions will need to be prepped in order to be turned into electronic files to meet the specifics of your request.
The charge is based on the time needed for an entry level waged clerk to do this work for you. We estimated no more than two hours will be needed. The cost quoted to you is based solely on the cost of the labor for this work to be completed. We have not added a cost per page. Once it is in pdf form - there is no further charge.
I understand your desire for anonymity and I honor your choice, but in order to accommodate you, I unfortunately have to request the charge in this circumstance. I also again offer you the opportunity for an appointment to inspect the documents directly.
Please advise on your choice.
Sincerely,
Jo-Ann O'Brien
