In pursuant of information for 1165 Bear Tavern Rd, Titusville, NJ 08560, BLOCK 98, LOT 98
I am requesting all open and closed construction permits, inspections, approvals, certificates of occupancy, violations, code enforcement records, and any records regarding underground oil tanks, environmental investigations, remediation reports, or environmental concerns pertaining to the property.

Thank you for your recent Open Public Records Act (OPRA) request.
To process your request, the Township requires specific certifications mandated by New Jersey statute. Your current submission is missing these required affirmations. To ensure your request is valid and to allow us to proceed, please complete the following section and return it to this office:

Under the Open Public Records Act (OPRA) and established guidance from the Government Records Council (GRC), the certifications on the official request form are not optional. Specifically, the GRC has consistently held that a request is "invalid" if the requestor fails to provide the required certifications (See Gannett v. County of Middlesex, GRC Complaint No. 2009-18). These certifications are necessary for the Custodian to determine if any statutory barriers to disclosure exist, such as those found in N.J.S.A. 47:1A-2.2.
A certification that is "left unanswered" or marked "unknown" is considered a failure to certify. Without a completed certification, the Township cannot verify your legal eligibility to receive certain government records.
Consequently, your request remains deficient and the 7-business-day response period will not commence until a fully executed and certified Township Official OPRA Request Form is received by this office.
