As per your request below:
You have requested access to building plans in your OPRA request attached. N.J.A.C. 5:3-2.2 (a) 1. provides that building plans submitted in conjunction with any permit application are exempt from disclosure under OPRA. The Reason for this exemption is building plans contain details about building construction and also about building security and safety systems that should not be available to just anyone on request.
Under the common law right of access to public records, the building plans may still be available. The common law right of access to public records does not prohibit an individual from receiving the record as long as they demonstrate a valid reason for doing so. The individual requesting the record must submit a written request to the Construction Official, Daniel Newman, stating the reason for obtaining or viewing the record. If the explanation is reasonable, access to the public record is granted
