Parking Lot A ( parking lot next to the Dover train station)
Dear Town of Dover,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
-Provide Process on how to get on waiting list for a parking space in Lot A.
-Provide current parking assessment report for all lots including lot A.
-Provide any reports or emails about parking lot A from Jan 1 2024 till August 2024
-Provide Policy on the list for spaces at Lot A
-Provide the list of all approved parking lot A leased spaces during from November of 2023 to August 2024.
-Provide list of available and leased spaces exist in total.
-Provide list of people on the lot A waiting list
I live in the town of Dover, and since November of 2023 I have been asking to rent overnight parking in parking lot A ( parking next to the train station).

The Town of Dover received your OPRA Request on 8/27/24. As such, the seven (7) business day deadline to respond to your request is 9/6/24. Pursuant to the Act, the Town has 7 business days, beginning the day after receipt of the request by the Records Custodian, within which to respond.

Your request requires an additional extension time beyond the seven (7) business days to fulfill. See Scheeler v. N.J. Dep’t of Educ., GRC Complaint No. 2014-123 (Feb. 2016) (validating extension under N.J.S.A. 47:1A-5(g) and N.J.S.A. 47:1A-5(i) where custodian provided written response within seven (7) business days and provided specific date when records would be ready). The Town anticipates that records readily identified as responsive to your request, with any necessary redactions, will be available to you by close of business on Friday, September 13, 2024. If the records become available before then, I will be sure to send them to you.

Please be advised that your request is partially overbroad under OPRA as it fails to adequately identify specific records, as required under OPRA. (A valid OPRA request must "identify with . . . specificity or particularity the government records sought"); Shipyard Assoc.'s v. City of Hoboken, 2015 WL 10352982, *5 (App. Div. Sept. 15, 2015) (finding use of "any and all" and "not limited to" improper under OPRA); see also Elcavage v. W. Milford Twp., GRC Complaint No. 2006-64 (May 2008) ("Because OPRA does not require custodians to research files to discern which records may be responsive to a request, the Custodian had no legal duty to conduct research to locate records potentially responsive to the Complainant's request."). However, the Town has conducted a search for responsive records.
Attached, please find the records that to the best of my knowledge are believed to be responsive to your request. It is important to note, the attached parking assessment is a DRAFT and has not been approved by the governing body. Redactions have been made to personal phone numbers pursuant to N.J.S.A 47:1A-5. There are no other records responsive to your OPRA Request.
