Ordinance 2026-001 / 161 Edgewood Terrace / Former Black Belt Site

Dear South Bound Brook Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

Pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq., I am requesting copies of the following government records related to Ordinance 2026-001, Resolution 2026-015, and the property located at 161 Edgewood Terrace, South Bound Brook, New Jersey, also referred to as the former Black Belt site.

Please provide the following records:

1. The full and complete text of Ordinance 2026-001, including all exhibits, attachments, schedules, appendices, project lists, and supporting documentation.

2. The full and complete text of Resolution 2026-015, including all exhibits, attachments, schedules, appendices, and supporting documentation.

3. Any capital improvement plan, project list, bond project list, funding schedule, or similar record identifying the specific improvements, properties, vehicles, equipment, site work, or other items to be financed through Ordinance 2026-001.

4. Any records showing whether 161 Edgewood Terrace, the former Black Belt site, is included in, connected to, referenced in, or expected to benefit from any project funded in whole or in part through Ordinance 2026-001.

5. Any engineer, architect, planner, administrator, CFO, bond counsel, financial advisor, environmental consultant, LSRP, or other professional memoranda, certifications, estimates, reports, recommendations, analyses, or correspondence prepared in support of Ordinance 2026-001 or relating to financing, remediation, excavation, demolition, site preparation, or redevelopment at 161 Edgewood Terrace.

6. Any cost estimates, construction estimates, remediation estimates, demolition estimates, excavation estimates, soil removal estimates, fill estimates, grading estimates, environmental consulting estimates, or related budget records associated with 161 Edgewood Terrace.

7. All meeting packets, agenda backup materials, briefing memoranda, internal summaries, handouts, attachments, and supporting documents provided to the Mayor and Council for the March 10, 2026 meeting concerning Ordinance 2026-001, Resolution 2026-015, or 161 Edgewood Terrace.

8. All emails, letters, memoranda, and other correspondence from January 1, 2025 to March 11th, 2026 between or among Borough officials, Borough professionals, the site owner, developer, contractor, engineer, environmental consultant, LSRP, bond counsel, financial advisor, Somerset County Soil Conservation District, Somerset County Board of Health, and NJDEP concerning 161 Edgewood Terrace, the former Black Belt site, including but not limited to financing, bonding, remediation, contamination, gasoline odor, excavation, demolition, site preparation, redevelopment, or public safety.

9. Any records reflecting the source and intended use of bond proceeds connected to remediation, soil removal, fill, grading, excavation, demolition, site preparation, environmental response, or redevelopment work at 161 Edgewood Terrace.

10. Any bond file, work papers, issue summaries, disbursement records, closing documents, requisitions, invoices, payment records, and supporting documentation relating to Ordinance 2026-001.

11. Any environmental reports, assessments, testing results, sampling data, laboratory reports, site investigation reports, remedial investigation reports, remedial action work plans, Response Action Outcomes, or similar records relating to 161 Edgewood Terrace that were reviewed, referenced, or relied upon by the Borough in connection with Ordinance 2026-001, Resolution 2026-015, or redevelopment of the site.

12. Any resident complaints, odor complaints, incident reports, field notes, contractor reports, disposal records, manifests, photographs, inspection records, or public notification materials relating to contamination, gasoline odor, or environmental remediation at 161 Edgewood Terrace.

I request these records in electronic format, preferably as PDF files sent by email.

If any portion of this request is denied, please provide the specific legal basis for the denial and identify any withheld records with sufficient specificity.

If any part of this request is considered overly broad, please produce all records that are responsive to the portions that are clear and permissible.

These overly broad and/or vague requests which require the Records Custodian to conduct research among all records maintained by the agency to locate and identify potentially responsive records, make such requests invalid under OPRA. Borough of Bloomsbury, GRC Complaint No. 2007-151 (February 2009). Requests for documents must identify with reasonable clarity the specific government records sought. Bent v. Stafford Police Department, 381 N.J. Super. 30, 37 (App. Div. 2005). In this matter, the words “any” and “all” in categories 3, 4, 5, 6, 7, 8, 9, 10, 11 and 12 are broad and vague therefore an invalid request under OPRA. Please eliminate these words in the clarifications requested below.
