In my capacity as Government Record Custodian for Brookdale Community
College, I received your Open Public Records Act (OPRA) request on
Thursday November 2, 2017.  As such, the seven (7) business day deadline
to respond to your request was Friday, December 1, 2017.  My personal
apologies for the delay in responding.

 

For ease of reference, the College notes that your OPRA request seeks the
following:

 

• I'm requesting copies of all OPRA requests from August 1, 2017 to
November 20, 2017.

 

Enclosed please find the record that the College was able to readily
identify as responsive to your request, for the following semesters:

 

• All OPRA requests received from August 1 2017 to November 20, 2017

 

Please be advised that the College is not required to create a document in
response to an OPRA request.  Bent v. Stafford Twp. Police Dept., 381 N.J.
Super. 30, 37-39 (App. Div. 2005) (noting that OPRA allows requests for
specific records, not requests for general information, data or
statistics); New Jersey Builders Association v. New Jersey Council on
Affordable Housing, 390 N.J. Super. 166 (App. Div. 2007) (same).  Please
be further advised that OPRA does not require the College to conduct
research to respond to an information request.  See MAG Entm’t LLC v. Div.
of Alcoholic Beverage Control, 375 N.J. Super. 534, 549 (App. Div. 2005). 
The College is specifically not obligated, under OPRA, to “analyze,
compile and collate” requested information.  Bent, 381 N.J. Super. at 37.

 

 

If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by Brookdale Community College to deny
access. At your option, you may either institute a proceeding in the
Superior Court of New Jersey or file a complaint with the Government
Records Council (GRC) by completing the Denial of Access Complaint Form.

P.O. Box 819, Trenton, NJ, 08625, by e-mail at
