OPRA request - Use of force reports 2017-2019

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

All use of force reports completed by the police department from January 1st 2017 to December 31st, 2019.

In response to your OPRA request, please be advised that
* 44 Use of Force reports for years 2017, 2018 and 2019 are attached.
* 11 Use of Force reports related to Domestic Violence cases are attached with redactions of the names and addresses to protect the victims as these records are exempt in accordance with N.J.S.A. 2C:25-33.
* 11 Use of Force reports related to Juveniles are attached with redactions of the names and addresses to protect the juveniles as these records are exempt as outlined in N.J.S.A. 2A:4A-60.
* 32 Use of Force reports related to Emotionally Disturbed Persons are attached with redactions of names and addresses to protect the privacy of the EDP in accordance with Executive Order No. 26 which mandates that “Information relating to medical, psychiatric or psychological history, diagnosis, treatment or evaluation,” Richard Rivera v. Office of the County Prosecutor of the County of Bergen, 2012 N.J.Super. Unpub. LEXIS 1921 (Law. Div. August 8, 2012).
You have a right to challenge the decision by the Township of South Brunswick to deny access. Information regarding an appeal process is attached for your information.
