OPRA Request - Unfulfilled - EWTPD
DEAR CUSTODIAN OF RECORDS:
I am resubmitting the attached Open Public Records Act (OPRA) request, which I originally submitted on February 27, 2025, to [email address], an email address listed on the Township’s OPRA Response Form. At that time, I was unaware that the Township’s website separately lists [email address] as the correct contact address for the Municipal Clerk.
On March 13, 2025, I again sent the request to [email address] and also submitted it to Karl Aponte, Support Services Supervisor for the East Windsor Police Department Records Bureau, whose email is publicly listed on the Township’s police website. Despite receiving the request, Mr. Aponte neither fulfilled it nor referred it to the proper custodian, in violation of his duty under N.J.S.A. 47:1A-5(h) to forward misdirected requests.
After locating what I believed to be the correct email address independently, I resubmitted the request on March 25, 2025, to [email address]. As of this writing, I have received no confirmation or response, I understand this request has not gone through the statutory time frame but due to the numerous failed attempts to make contact I am resubmitting this today to ensure accessibility to these records. Accordingly, I am submitting this request today, March 28, 2025, via the OPRA Machine platform.
The repeated failure to acknowledge or process this request in accordance with OPRA constitutes a denial of access under the law. I reserve all rights available under the statute.

Pursuant to the New Jersey Open Public Records Act (OPRA), N.J.S.A. 47:1A-1 et seq.,
Under penalty of N.J.S.A. 2C:28-3, I certify that:
• I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
• I, or another person, WILL NOT use the requested government records for a commercial purpose.
• I AM NOT seeking records in connection with a legal proceeding.
I hereby request access to the following records related to the incident involving Mr. John A. Casey on February 15, 2025, at 12:15 AM:
1. Body Camera Footage: All recordings from Patrolman Andrew F. Smith’s body-worn camera during the specified incident.
2. Dash Camera Footage: All recordings from the dashboard camera of Patrolman Smith’s patrol vehicle during the same timeframe.
3. Citation Copy: A complete copy of the citation issued to Mr. Casey, identified as Ticket Number EWT 158988.
4. Officer Narratives: Any written narratives or reports by Patrolman Smith or other officers detailing the incident and the rationale for issuing the citation.
5. Incident Reports: All reports generated concerning this incident, including those outlining the reasons for the citation and detailing officer interactions and actions throughout the encounter.
6. CAD Log: The Computer-Aided Dispatch (CAD) log entries corresponding to the incident.
