Regarding the footage:
The City has compiled the copious amount of hours of Body Worn Camera
footage that you are seeking and has ascertained that there are over six
(6) hours of responsive footage. Because all footage must be reviewed
carefully to ensure that they are appropriate for release under OPRA
precedent and further do not contain information that would affect an
individual’s legitimate expectation of privacy, the City has attempted to
discern how long such a review would take to review and redact information
protected under OPRA.
As such, your request would require an extraordinary expenditure of time
and effort to fulfill, and the City is therefore entitled to impose a
special service charge pursuant to N.J.S.A. 47:1A-5(c). This charge is
based upon the estimated actual cost incurred to the City by the lowest
level employee capable of fulfilling the request for the initial review of
the responsive records. OPRA mandates that the requestor shall have the
opportunity to review and object to the charge prior to it being
incurred. Id.
In this instance of the initial review, we have determined that individual
is Keyboarding Clerk 1 Kaitlyn Green, whose hourly rate is $23.63. Based
upon the City’s estimate of a minimum of 6.49 hours the initial review,
the estimated minimum special service charge is $153.35
Additionally, if it is determined that there is material requiring
redaction, that will have to be performed using a specialized program
maintained by the Hackensack Police Department. Because it is unknown at
this time as to how much time this effort may require, an estimate cannot
be provided as to the final cost to provide you with the responsive
records. If you wish to proceed with the initial review, a second estimate
will be provided once this anticipated cost can be ascertained by the time
it takes to complete the necessary redactions.
If you still would like for the City to review and produce the responsive
Body Worn Camera footage, you must remit a 50% deposit by submitting a
check or money order to the City Clerk’s office in the amount of $76.67
made payable to the City of Hackensack at this juncture. Given staffing
limitations and other City obligations, this request will further take a
substantial time to fulfill and will require an extension of twenty-one
(21) business days if you wish to proceed with your request. If we do not
hear from you by the close of business on March 20, 2026 we will treat
your request as abandoned and close our file.

Thank you for your quick response and for providing the requested report.
I am writing to object to the proposed special service charge and to narrow my request in order to reduce the burden on the City.
The arrest at issue occurred at approximately 20:10. Responsive Body Worn Camera footage would therefore be concentrated within approximately one hour of that time. I am narrowing my request to footage captured between 19:30 and 21:30 on the date in question. A review of this limited window should not require 6.49 hours of staff time.
Given that the relevant footage is limited to approximately one hour surrounding the arrest, this request may no longer warrant a special service charge under N.J.S.A. 47:1A-5(c), and I respectfully request that the City reassess whether any charge is appropriate. I further request a revised time and cost estimate reflecting this narrowed scope before any deposit is submitted.
Please confirm receipt of this narrowed request and provide an update at your earliest convenience.
