Dear Jacob Toby,

The Borough of Middlesex received your Open Public Records Act (OPRA)
request on May 11, 2022.  The official Records Custodian, Linda Chismar,
received your OPRA requests on May 11, 2022.

Your request sought access to the following:

1) We would like a list of all properties with tax liens on them.

2) we would like a list of all municipal held liens

3) we would like a list of all tax lien investors

4) and also we would like to know if the city assigns there municipal held
liens.

If you can provide these in excel spread sheet that would help as well.

Currently, item #2 (list of all municipal held liens), is  overly broad,
therefore, we are seeking clarification.  When a request does not name
specifically identifiable records or is overly broad, a custodian may deny
access pursuant to the following court decisions: MAG Entertainment, LLC
v. Division of Alcoholic Beverage Control, 375 N.J.Super. 534 (App. Div.
2005). A proper request under OPRA must identify with reasonable clarity
those documents sought. A custodian is obligated to search and a find the
identifiable government records listed in the Complainant's OPRA request.
A custodian is not required to search her files to figure out which
records, if any, might be responsive to a broad and unclear OPRA request.

Please clarify the document(s) you seek with regards to “a list of all
municipal held liens” (lien #, address, etc.) so that we may process your
request.  The seven (7) business day deadline to respond to your request
begins the day after said clarification is received.
