OPRA Request – Golden Eagle Estates Development
Dear Berkeley Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
I respectfully request access to and copies of the following public records related to the residential development known as Golden Eagle Estates (constructed or proposed by Arya Properties or related entities) located in or around Bayville, Berkeley Township, NJ:
1. All Planning Board and Zoning Board of Adjustment records (2019–present) pertaining to Golden Eagle Estates, including:
* Applications, site plans, variances, resolutions, and approvals
* Meeting agendas and minutes
* Any staff reports, engineering reviews, or correspondence related to the application
2. Building Department and Construction Office records for the development, including:
* Building permits, demolition permits, and certificates of occupancy or approval
* Inspection reports and final sign-offs
3. Engineering and Public Works records, including:
* Infrastructure improvement plans (roads, drainage, water, sewer, stormwater management)
* Performance and maintenance bonds submitted for the project
* Correspondence between the developer and the Township Engineer or Consulting Engineer
4. Contracts or professional service agreements (2020–present) between Berkeley Township and any of the following:
* Morgan Engineering LLC
* Morgan Municipal Services
* Morgan Architecture LLC
* Arya Properties LLC or any affiliated entity listed on the Township’s vendor list
5. Financial records, including:
* Developer’s escrow account records for Golden Eagle Estates (deposits, withdrawals, and balances)
* Any inspection, review, or administrative fees collected from or refunded to the developer
6. Any correspondence (emails or letters) between:
* Township officials, staff, or board members and representatives of Arya Properties or Morgan Engineeringrelating to Golden Eagle Estates.
* Please include correspondence from January 1, 2021 through the present.

fails to identify with reasonable clarity the specific government records
sought, as is required by Bent v. Stafford Police Department, 381
N.J.Super. 30, 37 (App. Div. 2005). At this time, we request clarification
of your OPRA request. Please respond in writing and identify the specific
government records sought so that we may process your request. Failure to
provide written clarification of your request will result in the closure
of this OPRA request.
