Automated Toll Enforcement, Vendor Ownership, Data Security, and Due-Process Records
Dear OPRA Custodian,
Please accept this electronic request for public records pursuant to the New Jersey Open Public Records Act (OPRA), N.J.S.A. 47:1A-1 et seq., and the common-law right of access.
Pursuant to N.J.S.A. 47:1A-6(f), this email constitutes a valid OPRA request. No agency-specific form or software platform is required.
This request is made:
• for public-interest and informational purposes only,
• not for any commercial use, and
• not to interfere with any pending legal proceeding.
STATEMENT OF PUBLIC INTEREST
New Jersey has expanded camera-based tolling, automated enforcement, and third-party processing, accompanied by escalating administrative fees and penalty schedules.
Public oversight is required where the State:
• delegates toll enforcement and data processing to private vendors,
• collects and retains motorists’ travel and identity data,
• imposes penalties far exceeding underlying toll amounts, and
• relies on automated systems for notice, billing, and enforcement.
This request seeks records necessary for residents to understand how these systems operate, who controls them, how vendors are compensated, and what safeguards exist for data security and due process.
RECORDS CUSTODIAN & CONTROL
If responsive records are created, received, relied upon, or controlled by the agency, they are subject to OPRA regardless of whether a contractor or vendor physically maintains them.
If you are not the proper custodian for any portion, please forward this request and identify the appropriate custodian.
SCOPE OF REQUEST
All government records created or maintained from January 1, 2020 to present relating to:
• E-ZPass and toll-by-plate systems
• Camera, gantry, and plate-reader infrastructure
• Vendor contracts and compensation
• Data collection, retention, and sharing
• Administrative fees and enforcement procedures
• Oversight, audits, and security reviews
RECORDS REQUESTED
I. OWNERSHIP & VENDOR DISCLOSURES
1. All ownership disclosures, certifications, or representations submitted by TransCore (or affiliates) in connection with any NJTA procurement.
2. Documents identifying:
• parent companies,
• affiliates or subcontractors,
• jurisdictions of incorporation,
• beneficial or controlling ownership interests.
II. CONTRACTS, BIDS & PROCUREMENT RECORDS
1. All RFPs, RFQs, bid submissions, evaluator scoring sheets, recommendation memoranda, award notices, and executed contracts for:
• E-ZPass services,
• toll-by-plate enforcement,
• data processing,
• camera or gantry systems.
2. All protests, appeals, or bid challenges, including responses thereto.
III. COMPENSATION & REVENUE STRUCTURE
1. Records reflecting:
• vendor compensation formulas,
• per-transaction or per-violation fees,
• administrative-fee allocation,
• revenue sharing or incentive provisions.
2. Internal cost studies, analyses, or reports used to justify administrative fee amounts.
IV. GANTRY & CAMERA DEPLOYMENT
1. Board minutes, resolutions, or approval packages authorizing:
• installation or expansion of gantries,
• camera or plate-reader systems,
• surveillance-enabled toll enforcement.
2. Contracts, scopes of work, and acceptance documents for such infrastructure.
V. NOTICE, BILLING & DISPUTE PROCEDURES
1. Policies, SOPs, training materials, and scripts governing:
• toll notices,
• violation notices,
• dispute handling,
• escalation to penalties or collections.
2. Records addressing:
• address verification,
• returned or undeliverable mail,
• suspension of enforcement during disputes.
VI. DATA SECURITY, RETENTION & SHARING
1. Records identifying:
• data captured (images, plate numbers, travel data),
• retention periods,
• deletion or minimization policies.
2. Data-sharing agreements or memoranda with:
• other agencies,
• law enforcement,
• private entities.
VII. OVERSIGHT, AUDITS & SECURITY REVIEWS
1. All audits, QA reports, or oversight reviews relating to toll enforcement or vendor performance.
2. All records created or received in response to the March 28, 2025 congressional inquiry regarding TransCore ownership and data security, including:
• internal analyses,
• security reviews,
• draft or final responses,
• related board discussions.
NON-EXISTENCE CERTIFICATION
If any category of records does not exist, please provide a written statement confirming:
• that no such records were created or maintained, and
• the reason for their absence.
FORMAT, REDACTION & EXEMPTIONS
• Provide records in native electronic format where available.
• Redact only information specifically exempt under OPRA.
• Provide a written exemption index for any withheld material.
