OPRA Request for Records Related to Enforcement of Bulletin No. 20-22 and Order No. A20-03
Dear New Jersey Department of Banking and Insurance,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
I am requesting access to records related to the enforcement of Bulletin No. 20-22 and Order No. A20-03 issued by the New Jersey Department of Banking and Insurance during the COVID-19 pandemic. Specifically, I seek:
1. All records, reports, or documents from March 2020 to December 2022 related to investigations or enforcement actions taken by DOBI against insurance companies for non-compliance with Bulletin No. 20-22 and Order No. A20-03, which required premium refunds, credits, or reductions in response to reduced risks during the pandemic.
2. All emails and electronic communications (including internal and external correspondence) from March 2020 to December 2022 that reference enforcement or compliance with Bulletin No. 20-22 and Order No. A20-03. This includes communications between DOBI officials, insurance companies, and other relevant parties.
3. Any internal memos or guidance documents issued within DOBI from March 2020 to December 2022 regarding monitoring or enforcing compliance with these directives.
4. A list of all insurance companies that were investigated or contacted by DOBI regarding compliance with these directives during the specified time period, along with any outcomes (e.g., penalties, fines, settlements).
Relevant keywords may include but are not limited to: “Bulletin 20-22,” “Order A20-03,” “premium reductions,” “COVID-19 enforcement,” “compliance investigations,” and “auto insurance.” Relevant individuals may include DOBI enforcement officers or officials involved in compliance monitoring during this period.
