Ms. Meza:

Our Clerk’s Office escalated your OPRA request to me.   To answer it, we
will need some additional information and confirmations from you.

First, I’ll identify some relevant law. 

Body worn camera footage is covered by the body camera
statute.  See N.J.S.A. 40A:14-118.5 et seq.  That statute exempts footage
from disclosure under OPRA pursuant to N.J.S.A. 47:1A-9, unless the
request falls into one of the exceptions in that statute, the most common
being that the requestor is a subject of the footage or situations where
footage involves an arrest.  (Here it does not appear as if there was an
arrest and it is unclear whether you are the subject of the footage.)  
Additionally, the matter about which involves a family matter in which the
subjects of the footage will likely have a reasonable expectation of
privacy pursuant to N.J.S.A. 47:1A-1.   Finally, the statute provides that
“[t]he requestor shall be required to certify whether the government
record is being sought in connection with a legal proceeding and identify
the proceeding for the request to be fulfilled.”  N.J.S.A. 47:1A-5(g). 

The City first needs to know whether you appear in the requested footage
as a subject thereof.  Do you?   If not, are you the parent or legal
guardian of anyone appearing as a subject of the footage?  If so, who are
the minors or others in your care?  

Second, your request indicates that this is not for the purpose of
litigation; however, it appears to have been submitted through third-party
software, which sometimes fills in incorrect information automatically.  
Further, it is merely a statement, not a certification.  Finally, you also
indicate that you are interested in a child custody dispute, which is
typically raised on connection with litigation (present or
contemplated) by parties thereto.  

So, to be sure that we have an accurate certification on file, please
reply using the below language, but picking either “Am” or “Am not”
depending on which is accurate. 

Under penalty of N.J.S.A. 2C:28-3, I certify that I AM / AM NOT seeking
records in connection with a legal proceeding.

Finally, in order to ensure that we protect privacy of subjects of
footage, please provide photo identification so that the City can verify
your identity in connection with the questions above for purposes of
determining privacy expectations and footage subject status.

. The only reason why it says custody dispute is because that was written on the paper that the police officers gave me along with their badge numbers and last names. I do appear in the requested footage, and so do my children, Camilla Bisset and Logan Bisset. I only mentioned the term custody dispute because that is what is written in the paper handed to me by the police officers with their badge numbers and last names. I googled how to make an OPRA REQUEST in Jersey city and this was what popped up. I got in contact with the city clerk Ms. Teli, after many months of no updates from this end. I am going to send identification via email to Ms. Teli and to Sean Gallagher.

Good afternoon Michelle,
 

Thank you for providing the identification and background information. 
Our law department has reviewed the BWC footage that we have and
determined that you do not appear in it.  The videos are short (approx. 3
minutes).  The children do appear but they get into a vehicle where the
driver is not visible.   Accordingly, the City has determined children are
subjects of the footage but that you are not. 

 

That being the case, we will need a further certification from you if you
wish us to release the footage to you based on the children.    Please
certify to whichever is true:

 

Under penalty of N.J.S.A. 2C:28-3, I certify that I AM / I AM NOT the
legal guardian of the children in the custody exchange shown in the
body-worn camera footage I seek under my February 5, 2026 OPRA request
