OPRA Request For Bodycam Footage & Incident Reports
Hello,
Under penalty of NJSA 2C-28-3.1 I certify that I, Keith Moreno of Houston, Texas, have not been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
Under the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq., I am requesting an opportunity to obtain all body-cam footage, dash-cam footage from police vehicles, and any incident reports pertaining to Incident #24AP02623 on 2/2/2024 involving officer Daniel Savastano UOF24-2-15 and a 20-year-old Black or African American male suspect.
If multiple officers with active BWC responded to this incident, I would appreciate footage POVs of a primary and secondary arresting officer. I apologize for not being able to provide you with the arrestee's name, or time and location of incident, I hope the information provided will nonetheless be enough to retrieve these records.
These records are not being sought for commercial purposes, or legal purposes. I'm extremely grateful for all of your assistance in this matter. Response: This matter relates to a Domestic Violence incident and thus,
this request is hereby denied based on the following exemptions:
• The Prevention of Domestic Violence Act, NJSA 2C:25-33 which states, “
all records maintained pursuant to this act shall be confidential and
shall not be made available to any individual.”
• NJ Court Rule 1:38-3(d)(9), which sets forth those public records that
are excluded from public access under the above cited PDVA.
• OPRA Exemption listed under NJSA 47:1A-9(a)- this statute upholds the
exemptions contained in other State or Federal statutes and
regulations, Executive Orders of the Governor, Rules of Court, the
Constitution of the State of NJ or judicial case law. Thus, the PDVA
and NJ Court Rule 1:38 cited above would be statutes that provide for
exemptions under NJSA 47:1A-9(a)
