While you are not required to utilize the OPRA form, in order for me to process this under OPRA, you do need to provide me with the information:
Under penalty of N.J.S.A. 2C:28-3, I certify that
1. I HAVE / HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States;
2. I, or another person, WILL / WILL NOT use the requested government records for a commercial purpose;
3. I AM / AM NOT seeking records in connection with a legal proceeding.

As a reminder to you, please be aware that “Commercial purpose” is broadly defined under OPRA to include “the direct or indirect use of any part of a government record for sale, resale, solicitation, rent, or lease of a service or any use by which the user expects a profit either through commission, salary, or fee.” N.J.S.A. 47:1A-1.1. If Asset Management Consultants, which we understand to be a for-profit corporation, intends to use the requested records in any way in connection with its for-profit operations—this would constitute a “commercial purpose.”

Please be advised that the intentional failure to certify that a records request is for a commercial purpose is subject to the imposition of civil penalties under N.J.S.A. 47:1A-11(b). In addition, as indicated on the OPRA request form, the certifications made therein are made under penalty of perjury, which is a fourth-degree criminal offense under New Jersey law. N.J.S.A. 2C:28-3(a).
